1. Introduction

Welcome to Wayyti™ operated by Product Enterprises Pty Ltd (ABN: 28674754235). By accessing or using our app, you agree to comply with and be bound by these Terms of Service. If you do not agree with any part of these Terms, please refrain from using the app.

2. Core Functionalities

Wayyti provides the following core functionalities:

• Product search
• Price tracking for selected products
• Price drop notifications for tracked products
• Accumulation of reward points based on tracked items, login frequency, referrals, and shared deals
• Exchange of reward points for entries in the monthly prize draw

3. Account Registration and Third-Party Login

To use Wayyti’s services, you will need to register an account ("Account"). You may register by signing in through supported third-party login options, such as Facebook, Google, or Apple ("Third-Party Login Accounts"). By registering with a Third-Party Login Account, you confirm that it is your own account and that you have the necessary rights to provide Wayyti with the information associated with that account.

4. Restrictions on Use

Users are permitted to use Wayyti solely for its intended purposes as outlined in these Terms. Any misuse of the app, including illegal activity or actions that contravene these Terms, is strictly prohibited. Users shall not:

• Interfere with or disrupt the app, servers, or networks
• Use data-mining, scraping, or similar data-gathering tools
• Reproduce, copy, combine, or aggregate app content without express authorization
• Engage in unauthorized access, hacking, or any activity that compromises app security

5. Age Requirement

Users must be at least 16 years old to use Wayyti. By using the app, you confirm that you meet this age requirement. Wayyti does not knowingly collect personal data from users under the age of 16. If Wayyti becomes aware of such data, we will delete it promptly.

6. Subscription, Payment Terms, Cancellation, and Refunds

6.1 Free Trial Period

Wayyti provides a 2-month free trial period, during which users can explore the app's features without incurring charges. Upon registration, users select either a monthly or annual subscription plan, which will automatically commence at the end of the trial period unless canceled. If a user cancels during the free trial period, they will retain access to Wayyti until the end of the trial period, after which no subscription charges will apply.

6.2 Subscription and Renewal

Payments for subscriptions are processed exclusively through Apple Pay and Google Pay. Subscriptions will automatically renew at the end of each billing cycle unless canceled by the user before the renewal date. Users can manage and cancel their subscriptions via their respective payment platforms at any time.

6.3 Cancellation

Users may cancel their subscription at any time via their Google Pay or Apple Pay account settings. Cancellations will take effect at the end of the current billing cycle, and users will continue to have access to Wayyti’s features until the end of the paid period. If canceled during the free trial, access will continue until the trial ends without any charges.

6.4 Refunds

Once a payment has been processed, refunds are generally not provided. However, Wayyti will comply with applicable consumer protection laws in your region, which may entitle you to a refund under specific circumstances. Users seeking a refund should consult the policies of the platform they subscribed through (Apple Pay or Google Pay) and follow the refund process as outlined by that platform.

6.5 Platform-Specific Subscriptions

Subscriptions purchased through Wayyti are tied to the platform on which the purchase was made (iOS or Android). Due to the unique requirements of Apple and Google’s subscription systems, subscriptions are managed exclusively by the platform used for the purchase.

This means that a subscription bought on one platform does not grant access on another platform. If you switch devices or platforms, you will need to purchase a new subscription on the new platform to continue using Wayyti.

We understand this may be inconvenient, but it is a limitation of how Apple and Google manage subscriptions through their systems. For more information on managing your subscription, please see Section 6.6.

6.6 Subscription Management

Management of subscriptions, including cancellation, renewal, or payment updates, must be conducted through the platform where the subscription was originally purchased.

• For iOS subscriptions: Manage your subscription through your Apple ID settings.
• For Android subscriptions: Manage your subscription through your Google Play account settings.

6.7 Non-Transferability

Subscriptions purchased through Wayyti are non-transferable between platforms. This means that switching from iOS to Android, or vice versa, will require purchasing a separate subscription for the new platform.

This limitation is due to Apple and Google managing subscriptions independently, with no mechanism to transfer subscription status between the two systems.

If you switch platforms, we encourage you to cancel your subscription on the original platform to avoid being charged for a service you no longer use. Please note that unused portions of your subscription are not eligible for refunds unless required by local laws. For details, refer to our Refund Policy in Section 6.4.

7. Third-Party Websites and Links

Wayyti provides links to third-party websites for items users search for and track. These external websites are operated by third parties over whom Wayyti has no control. Inclusion of such links does not constitute an endorsement, and Wayyti disclaims any responsibility for the content or privacy practices of these third-party websites. Users are encouraged to review the terms and privacy policies of any third-party sites they visit.

8. Publicly Accessible Data Only

Wayyti’s technology is designed to retrieve publicly accessible information to display search results, price information, and other relevant content to users. Search results and product availability may be limited based on the regional data sources Wayyti accesses, which may not capture all items or all retailers. Users are advised to verify product availability and pricing directly with retailers.

9. No Liability for Missed Deals

9.1 Responsibility for Missed Deals

Wayyti disclaims liability for any missed savings opportunities arising from delays in notifications or user response times.

9.2 User Responsibility

Users are encouraged to regularly review tracked items to monitor price changes in real time.

10. User Declarations

• Tracked Item Purchases: Users may indicate a purchase by selecting a checkbox next to tracked items after a price change. This feature is for organizational purposes only and does not verify actual purchases. Points earned from marking items as purchased are based on user input. Users agree not to falsely declare purchases.
• Sharing and Referral Points System: Users may earn points by sharing deals or referring friends to the app. Points are awarded based on engagement with the sharing function. Users agree not to falsely claim they have shared deals or made referrals.

11. Gift Card Prize Draw

11.1 Gift Card Currency

All gift card prizes are in AUD unless otherwise specified.

11.2 Acceptance of Draw Terms

By entering the gift card draw, users accept the following conditions:

• Each entry requires the exchange of 50 points, and points reset monthly.
• The draw is random, and winners will be notified via in-app messages or email.
• Wayyti assumes no responsibility for any taxes or fees associated with prize redemption.
• Wayyti may require winners to verify their identity, age, or residency to comply with local regulations.
• If a winner does not select their preferred gift card within 14 days of the reminder email and push notification, the prize will be forfeited.

11.3 Gift Card Fulfillment and Distribution

Digital gift cards will be delivered electronically and are subject to the issuing platform’s terms and conditions. Users are responsible for reviewing and complying with these terms. Gift cards are valid for the specified period and are non-exchangeable and non-refundable.

11.4 Transparency for Points Redemption

Once points are redeemed for entries in the gift card draw, they are non-refundable. Users will receive a confirmation of their entries via in-app notification or email.

12. Data Collection and Usage

By using Wayyti, you consent to the collection, use, and retention of your personal information as described in our Privacy Policy. This includes data on app usage, interactions for reward points, analytics, notifications, Single Sign-On (SSO) data, and location information.

13. Disclaimers

The app and its content are provided on an “as-is” and “as-available” basis without any warranties of accuracy, reliability, or availability. Wayyti does not guarantee the accuracy of price-tracking data, product availability, third-party shopping results, or price-drop notifications. Wayyti disclaims all liability for service interruptions, bugs, or technical issues and does not warrant that the app is free from viruses or harmful elements.
Prices and product information displayed in the app are sourced from third parties, and Wayyti cannot guarantee their accuracy or timeliness. Users are advised to verify all information directly with the vendor.

14. Device Requirements and Compatibility

14.1 Minimum Device Requirements

• iOS: Version 12 or higher
• Android: Version 5.0 (Lollipop) or higher
  Wayyti may not support devices running older operating systems. Certain features may perform optimally on more recent devices.

14.2 Compatibility with Future OS Versions

Wayyti is designed to be compatible with future updates to iOS and Android. However, compatibility cannot be guaranteed if future OS updates introduce technical limitations beyond Wayyti’s control.

14.3 Device Performance and Limitations

Wayyti is optimized for a range of device specifications. However, performance may vary depending on device age, RAM, and processing capacity.

15. Limitation of Liability

Wayyti shall not be liable for any indirect, consequential, or incidental damages arising from the use of the app. Our liability is capped at the amount paid for the subscription.

16. Indemnification

Users agree to indemnify, defend, and hold Wayyti harmless from any claims, damages, liabilities, losses, or expenses (including legal fees) arising from their violation of these Terms or misuse of the app.

17. Intellectual Property and Proprietary Rights

All trademarks, logos, app features, and content within Wayyti are the property of Wayyti and are protected as proprietary assets. Users are prohibited from copying, distributing, reproducing, reverse-engineering, or misusing any part of the app without express permission. This includes but is not limited to proprietary gamification elements, user interface design, reward systems, and points-based mechanics. These unique features, structure, and organization are protected as trade secrets and copyrighted content and may not be used, disclosed, or replicated in any form without authorization.

Wayyti reserves all rights to the app’s proprietary elements, and users are bound by these restrictions regardless of the patent status of individual features. By posting content on Wayyti, users grant us the right to display it as part of our platform. We reserve the right to remove any content suspected of infringing on intellectual property rights or proprietary elements.

18. Account Termination

Wayyti reserves the right to terminate user accounts immediately for misuse, violation of these Terms, or non-payment. No prior notice will be provided for account suspension or termination.

19. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of New South Wales (NSW), Australia, and shall apply to users in all jurisdictions. Any disputes arising from or related to these Terms will be resolved exclusively in the courts of NSW.

20. Business Transfers

In the event of a sale, merger, or transfer of our business or assets, Wayyti may disclose personal information to the acquiring party. Any such transfer will be conducted in compliance with applicable data protection laws.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

22. Limitation of Claims

Any claims or causes of action arising out of or related to the use of Wayyti must be filed within one (1) year after the cause of action arose; otherwise, such claims are permanently barred.

23. No Waiver

The failure of Wayyti to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

24. Entire Agreement

These Terms constitute the entire agreement between you and Wayyti regarding the use of the app and supersede all prior and contemporaneous agreements, understandings, or representations.

25. Amendments to Terms

Wayyti reserves the right to amend or modify these Terms at any time. Users will be notified of significant changes, and continued use of the app after such changes constitutes acceptance.

26. Privacy Policy

Use of the app is subject to the Wayyti Privacy Policy, which governs the collection, use, and protection of user data.

27. Unauthorized Use

Any unauthorized use of Wayyti, including unauthorized access to data or third-party access, is strictly prohibited and may result in account termination or legal action.

28. Force Majeure

Wayyti shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including natural disasters, war, strikes, government actions, pandemics, or technical failures.
